Tutor121 Terms and Conditions

We are Scoco Limited, a limited company incorporated t/a Tutor121.co.uk in England and Wales. Registered in England No 4463107.  VAT reg No. 758 1910 11.

These Terms set out the terms and conditions (the “Terms”) on which we provide our Tutor121.co.uk Website and the Services available through the Website and Other Social Media Platforms.   By using the Website or our Services or registering with us, you are confirming that you agree to these Terms so please take the time to read and understand them.

You should be aware that these Terms may change from time to time, but we will always provide you with notice if they do change.

IMPORTANT: You must ensure that the e-mail address and other contact details (such as postal address, postcode, and telephone number) we hold for you are kept up-to-date. We may need to contact you for important messages. If you change your contact details you must inform us of the new details by email.


 INTERPRETATION

“Website” means the Tutor121.co.uk domain.

“User” means any user of the Website or the Services.

 “Client” means any User of our Website who registers as a Client.

“Services” means the services available through the Website to Clients.

 “Tuition Arrangement” means an arrangement for a Tutor to perform services for a Client as agreed between the Tutor and the Client.

In these Terms, words importing the singular include the plural and vice versa and words importing the masculine gender include the feminine gender and vice versa.

All and any business undertaken between you and us is subject to these Terms. In the event of any conflict between these Terms and any other agreement, these Terms shall prevail unless expressly otherwise agreed between you and us in writing. No variation of these Terms shall be valid if made without our written consent.

These Terms supersede all previous terms of business.

In these Terms, any phrase that includes the words other, including, for example, such as or in particular (or any similar expressions) shall be deemed to include the phrase "without limitation".


OUR SERVICES

We provide Services to Clients seeking access to education.

Our Services include the following (for full details of each Service, please see the Website):

One of the primary benefits of private tuition is that the Tutor can tailor his/or her method to the needs of the individual student in a way that cannot be achieved in the larger group classroom setting. There is no set pattern or material for private tuition. Every student is an individual, and student and Tutor need to find their best approach together. The background information given before starting is of great help and the Tutor will ask for any additional information needed.

At the start, it can be difficult to determine how much tuition a student requires. Tutor121 tries to be as flexible as possible as it is important to get the balance right for you and your child. Some parents use private tuition as a year round supplement to their child’s education. For others, just a few sessions may be required as a top-up and confidence builder prior to an exam. All parents and students would like to see private tuition as a quick fix, in reality it is not. It can take time for trust and rapport to be built between Tutor and Tutee.  Tutor121.co.uk will endeavour to design a suitable tutoring package taking into consideration your individual requirements, which you communicated to us prior to commencement of Tutoring.

ONLINE TUITION

Online tuition is Live Remote 121 Tuition over the internet when tutor and student are not in the same location. Live Remote tuition can also be used to supplement face-to-face sessions. Tutor121.co.uk use Zoom software which includes the ability to use powerpoint, webcams and interactive white board and document sharing.  It can be a very powerful and flexible tuition method and can be delivered to students in quiet study rooms during “free periods” during the school day. All online tuition is paid in advance. Live Remote 121 Tutoring is available as an ongoing service and as a package just the same as 121 tutoring.  All terms and conditions relating to face-face-tuition apply with online

FACE TO FACE TUTORING IN CLIENT HOME

Tuition normally consists of one-hour sessions. Shorter or longer sessions should be agreed in advance between client and Tutor.

Please ensure that tuition can be conducted in a quiet atmosphere conducive to concentration on the tuition involved. Provision of exercise books and textbooks is the responsibility of the client.


OUR PAYMENT PLANS

Tutor121 offer weekly payment, monthly payment and deal packages. 

Weekly payment must be made by the end of each tutoring session.

Monthly payment must be made in advance before the first day of each month for all sessions due in that month.  Monthly payment plans are bespoke to each Client’s needs. 

Deal Packages must be paid in full at the commencement of the deal.   

By selecting a prepayment plan, you are offered a reduced rate for an agreed number of sessions, which are paid in advance. Payment must be made prior to the commencement of the first session. Once tuition has commenced, there are no refunds for the cancellation of sessions by the client prior to completion of the course. However, the course is flexible in terms of illness and holidays, and sessions can be rescheduled for an alternative date if the client provides a minimum of 24 hours notice of the cancellation of the session to the Tutor. The course of sessions can commence at any time of year.

Non payment of weekly paid fees at the end of a tutor session will prompt the creation of an email Invoice for which payment will be due no later than 7 days from the date of the invoice.  No further tutoring sessions will run until payment has been made for services already received.  Clients must be aware that this may result in the loss of a tutoring slot therefore ongoing continuity of tutoring services. Tutor121 may charge interest on the balance outstanding at a rate of 10% per annum above the base-lending rate set by the bank of England from time to time from the due date to the date that the outstanding sum is paid, and whether or not a Court order for payment has been obtained.  If any sums remain unpaid for 7 days, Tutor121 will initially send the Client reminder letters until such sums (including interest thereon and other reasonable costs) are paid. A charge of £15 per letter will be made (which sum will be added to the overdue sum and interest charged thereon) to cover Tutor121 administration costs. (This is to avoid the costs of collection increasing tuition costs generally and affecting all Clients.) 

At the end of the prepaid deal course, tuition automatically carries on unless you give one-week’s notice (Termination Notice) both to your Tutor verbally and in writing to Tutor121.co.uk.   If you do not provide the Termination Notice to Tutor121.co.uk or do not provide such notice in sufficient time, Tutor121.co.uk will assume that you wish to continue and keep your agreed time slot with the Tutor reserved for you, and you will be charged for any such sessions arranged. This aids continuity and the Tutor’s availability as long as you need him/her. In this case, your account will automatically default to the monthly payment plan, where you will be billed monthly, in advance, at the full session price.

If a Client would like to carry on at a discounted deal package rate, they must contact Tutor121.co.uk no later than the last prepaid session, and prepay for another “course” of sessions. The rate agreed in the initial course of prepaid sessions is valid for 100 days from the start of the course. 

Fees are agreed in email by Tutor121.co.uk with the client prior to commencement of the tuition. They are normally at a standard rate appropriate to the level of tuition provided. A reasonable charge for travel may be required by a Tutor depending on location. This will be discussed with you prior to commencement of a contract. In the event a Tutor requires travel expenses, there is no discount on travel in the prepayment agreement. This charge is added to the total as a separate item with all prepayments.

VAT will be included within fees as appropriate.


CLIENTS

Your Relationship with Your Tutor:   Clients should understand that Tutors are self-employed and you should take responsibility for ensuring your Tutor fulfils their end of the bargain at every step of the relationship.

You hereby confirm that you are not less than eighteen years of age. Any person seeking to use the Website or our Services who is less than eighteen years of age must arrange for a parent or guardian to register with us on their behalf and that parent or guardian will be the Client for the purposes of these Terms.

The Tutor is engaged by the Client only to provide tuition and is not responsible for the safety, welfare, well being and care of minor Students or for the protection of any person’s property.  Tutees under the age of 18 should not be left in the sole care of the Tutor and a parent or guardian must always be present for the duration of a tutoring session irrespective of where the tutoring is delivered.

FEEDBACK

Clients may submit feedback in relation to Tutoring Services through the contact us form on the Tutor121.co.uk Website.

Clients may submit scores and written comments on our facebook page @tutor121.

PRECAUTIONS

You are responsible for ensuring your own protection and we cannot be held liable if the Tutor does not meet your own expectations. 

Entering or seeking to enter a Tuition Arrangement and engaging with a Tutor in any manner prior to entering a Tuition Arrangement is entirely at your own risk.


CANCELLATION AND REFUNDS

ATTENDANCE

The minimum charge for the attendance of a Tutor at a session is your hourly rate of charge for that Tutor. Please note that there can be considerable preparation involved before each session of tuition, in addition to travel time and cost to the Tutor.

ILLNESS & HOLIDAYS

Both the Client and the Tutor agree to notify the other in advance of any holiday commitments they may have; and any changes to the tuition timetable necessary because of illness. The Client and the Tutor will try to arrange an alternative date for cancelled tuition. If the Client fails to notify the Tutor and the Tutor makes her/himself available for tuition or the Client fails to give at least 24 hours’ notice of cancellation to the Tutor, the Minimum Fee will be charged. The Minimum Fee is the contractual hourly rate of charge.

CANCELLATION POLICY

You are, however, entitled to cancel the contract within 8 working days of your acceptance or deemed acceptance of these Terms (“Cancellation Period”), in which case you will be entitled to reimbursement of all Fees paid to Tutor121.co.uk.  However, if you instruct Tutor121.co.uk that you want the tuition sessions to commence before the end of this Cancellation period, you will not be entitled to receive a refund of the Fees paid in the event that such tuition session has already been arranged to take place prior to your cancellation.

TUITION STOPPED BY CLIENT

Please give at least a week’s notice of end of tuition in writing both to your Tutor and to Tutor121.co.uk, so that your Tutor may conclude his/her work with the student plan his/her work with the student and plan his/her own commitments. This cancellation provision applies after tuition has commenced and must be made by email.  The notice will be deemed to have been received by Tutor121.co.uk the second working day after the notice was emailed.

CLIENT SATISFACTION POLICY

Sometimes a Tutor’s teaching method or personality may not suit the student involved. If this is the case, please contact us straight away.   When a client has prepaid for a course of tuition, and a client is not satisfied with a particular Tutor or if a Tutor must stop tuition mid-course due to unforeseeable circumstances, Tutor121.co.uk will endeavour to find a replacement Tutor. If a replacement cannot be found of the level and subject required by the Client, then Tutor121.co.uk will refund the balance of the course fees paid by the client representing the number of pre-paid sessions for which the client does not receive tuition.

If your Tutor fails to attend a session and (a) you do not want to reschedule the session with that tutor or (b) you cannot find another suitable date when both you and your Tutor are available, at our sole discretion, we determine to provide you with a refund.



SAFEGUARDING

You agree that Tutor121.co.uk has no responsibility or liability for you or your child’s welfare at any time while you are engaged in a Tuition Arrangement, except as may not be excluded by law.

The Tutor is engaged by the Client only to provide tuition and is not responsible for the safety, welfare, well being and care of minor Students or for the protection of any person’s property.  Tutees under the age of 18 should not be left in the sole care of the Tutor and a parent or guardian must always be present for the duration of a tutoring session irrespective of where the tutoring is delivered. Clients over the age of 18 should inform a friend or relative of his / her plans, including the provision to a friend or relative of the name of the Tutor, times of tutoring, and the location that the tutoring is to be provided.

Tutors introduced by Tutor121.co.uk are highly qualified with university degrees, teaching certificates, professional qualifications or a combination thereof. Although mostly from a school teaching background, experience come from other walks of life including training establishments. This allows tuition to be offered in business, commercial and technical subjects too.  Our selection process includes professional references in respect of Tutors and checks with the Disclosing and Barring Service (DBS) with certificates available for inspection.

Clients may request certain documentation as proof of a Tutor’s qualifications.


OUR RIGHTS

In order to protect the integrity of our Website and Services and the interests of Clients, we retain certain rights with respect to cancellation fees and the right to remove and edit any feedback posted on the Website.

YOUR CONDUCT

These Terms and your account may always be terminated if you violate their terms, which includes providing false or defamatory comments on Tutor121.co.uk. 

Your conduct toward us. If you make defamatory, untrue, inaccurate, or malicious written or verbal statements about Tutor121.co.uk  (including for example through a web based review site or on social media), we reserve the right to terminate our arrangement with you without notice and without liability. Where advance payment for Services has been made, we may make a pro-rata refund for the remainder of the Services not yet used or provided, but, for clarity, no refund will be made for Services already provided.

By your use of the Website and our Services, you agree you will not:

do anything that may lead to the encouragement, procurement, or carrying out of any criminal activity;

do anything that may cause you or us to breach any applicable laws;

e-mail, transmit or otherwise disseminate any material which is defamatory, obscene, vulgar, or indecent or may have the effect of being harassing, threatening, abusive, or hateful or that otherwise discriminates against, degrades, or intimidates an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age, or disability, or which breaches the rights of others (including copyright and other intellectual property rights);

transfer files that contain viruses, trojans, or other harmful programs or use the Website in any way that may damage or disrupt another's computer;

access or attempt to access the accounts of other Users, penetrate or attempt to penetrate the Website security measures, or use the Website or our Services as a means to collect or store personal data about others;

include identifying information (such as telephone numbers, e-mail addresses, message service identifiers, voIP identifiers, postal addresses, website addresses or name, company name, tuition agency or organisation, or any other contact information through which you can be contacted) on the Website or in any messages sent to other Users through the Website or otherwise in any of your User Content; or

use the Website and / or our Services other than in good faith for your own purposes as an individual Client. For the avoidance of doubt, use of the Website and / or the Services by organisations such as employment agencies is not permitted.

RIGHTS IN THE WEBSITE AND ITS CONTENT

While you are permitted to view the content we make available on our Website, other uses such as copying, reproducing, republishing, downloading, posting, broadcasting, recording, transmitting, commercially exploiting, editing, communicating to the public, or distributing in any way our content is prohibited. Your access to our Website does not give you any rights in the Website or its content.

Prohibited conduct. You may not copy, reproduce, republish, download, post, broadcast, record, transmit, commercially exploit, edit, communicate to the public, or distribute in any way the services, web pages or materials on the Website, or the computer codes of elements comprising the Website other than for your own personal use.  You may download insubstantial excerpts of this content to your hard drive for the purpose of viewing it provided that no more than one copy of any such information is made.

No rights. Your use of the Website and its content grants you no rights in relation to any intellectual property (including copyrights, trademarks, and design rights or patents in relation to logos, graphics, photographs, images, sound recordings, compositions, animations, videos and text) (“IP Rights”) in the Website and its contents and in relation to our Services, whether owned by us or by third parties or IP Rights in any User Content submitted to the Website by other Users.


LIMITATION OF OUR LEGAL OBLIGATIONS

You have certain statutory rights in relation to the services provided by us, including the right to receive a reasonable standard of service. Nothing in this Section shall restrict those statutory rights. For further information about your statutory rights please contact your local Trading Standards Department or Citizens' Advice Bureau or the local equivalent of such bureaus.

We accept liability for death or personal injury caused by our negligence or that of our employees and agents. We do not seek to exclude liability for fraud by us or our employees or agents.

If we breach these Terms we shall only be liable for losses that are a reasonably foreseeable consequence of such a breach. Losses are foreseeable where they could be contemplated by you and us at the time of entering into an agreement on these Terms.

You agree and acknowledge that we shall not be responsible or liable for:

indirect losses which are a side effect of the main loss or damage and which are not reasonably foreseeable by you and us at the time of entering into the agreement on these Terms, including loss of profits and loss of opportunity; or

failure to provide the Website or our Services or to meet any of our obligations under these Terms where such failure is due to any cause or event beyond our reasonable control.

We do not accept any liability for damage to your computer system or loss of data that results from your use of the Website and we cannot guarantee that the Website or any files that you download are free from viruses, contamination, or destructive features.


LIABILITY FOR TUITION ARRANGEMENTS

Tutor121 and Scoco Limited have no responsibility or liability in relation to any aspect of any Tuition Arrangement;

It is the Client’s sole responsibility to verify the Credentials of any Tutor and to assess the quality and benefit of tuition received.

Tutor121 and Scoco Limited have no responsibility for any grade or test score received by a Client or Tutee and any consequence that a grade or test score may entail;

Accordingly, to the extent that the law permits, you agree and acknowledge that your use of the Website and our Services is entirely at your own risk and you release us, our directors, contractors, and employees from all liability (including in relation to disputes with other Users) where such liability relates to or arises out of the behaviour of (or the User Content or other material provided by) other Users and other third parties.

Whilst we use all reasonable endeavours to correct any errors or omissions as soon as practicable once they have been brought to our attention, we do not promise that the information and other material on the Website itself will be free from errors or omissions.

Although we reserve the right to monitor your use of the Website and the User Content, we may not always do so and we do not control, and are not responsible for, the User Content submitted by you or other Users of the Website and, as such, we do not guarantee the accuracy, integrity, or quality of such User Content. Furthermore, we recommend that you run anti-virus programs on any information, content, and / or User Content obtained via the Website. We will, however, seek to react quickly to any complaints regarding the Website, any User Content or other content on the Website or the conduct of other Users and we treat such complaints very seriously. If you wish to make a complaint please contact us.

We do not make any promise or representation in respect of the Website or its content, including any assessment of User Content, any advice given (on a personal or general basis) and any statements made by Users, advertisers, or other third parties on or via the Website. Any decisions or actions taken by you on the basis of information provided on or via the Website are at your sole discretion and risk and you should obtain individual professional advice where necessary.

You promise to compensate us for all (if any) claims, liabilities, costs, and expenses (actual or consequential) that we may suffer, which arise out of or in connection with your use of the Website and / or the Services, in particular in relation to: your breach of any provision of these Terms;

By accepting these Terms you are consenting to the use of your personal data as detailed in the Privacy Policy.

AMENDMENTS TO TERMS AND CONDITIONS

We are constantly looking for new ways to improve the Website and our Services. We therefore reserve the right to amend these Terms at any time by giving you notice. We may also change these Terms for legal, regulatory, or security reasons by giving you notice. Notice will be given by means of a notice on the Website and a link to the current version of these Terms will at all times be available on the Website. For particularly important changes to these Terms, we may in addition e-mail you to bring such changes to your attention. We will, however, use reasonable skill and care to overcome these difficulties where they are within our reasonable control.

Where we reserve a right in these Terms, it does not mean we will be obliged to exercise it.

You acknowledge that we are entitled to alter the amount or the basis of the calculation of our fees from time to time, provided that such amount or basis is clearly stated at the time when you are making the relevant purchase, prior to any fees being taken.

Together, these Terms and our privacy policy contain the whole of the agreement between us and you concerning the Website and our Services and replace all earlier agreements and understandings with you, provided that nothing in these Terms will limit liability for fraud. A person who is not a party to an agreement based on these Terms has no right to rely upon or enforce any provision of that agreement.

If any provision of these Terms is held to be invalid or unenforceable, the remainder of these Terms shall remain valid and enforceable.

These Terms and any claim or dispute (whether contractual or non-contractual) in relation to these Terms shall be governed by and interpreted in accordance with relevant United Kingdom law. If you wish to take court proceedings against us you must do so within the United Kingdom.

Scoco Limited do not hold a separate electronic database of data captured in the conduct of Tutor121 services.

Scoco Limited is committed to maintaining the trust and confidence of our visitors to our website. This Privacy Policy explains the types of personal data that we may collect from you, how we use it, the limited conditions under which we may disclose it to others, how we keep it secure, and your rights regarding your personal data.

Student Profile Data (only applicable to students) includes the subject in which you desire tutoring and your level of education.  Further to this records may be made on an ongoing basis in relation to student tutoring needs in the direct provision of tutoring services.

Messaging Data includes any information provided by your use of the website’s messaging system.

Aggregate Data. Aggregate data may be derived from your personal data but this data does not directly or indirectly reveal your identity. For example, we may aggregate certain usage data to calculate the percentage of users accessing a specific website feature. However, if we combine or connect aggregate data with your personal data so that it can directly or indirectly identify you, we treat the combined data as personal data which will be used in accordance with this privacy notice.

  • Third party businesses who process payments on our behalf.

  • Third party businesses who provide cloud storage services.

  • Third party businesses who help us develop our business, inform our marketing strategy, and maintain our website with relevant services.

  • We will disclose your information if we are required to by law. We may disclose your information to enforcement authorities if they ask us to, or to a third party in the context of actual or threatened legal proceedings, provided we can do so without breaching data protection laws.
